WILL

In the name of God. Amen. The Seventh day of December in the Eighth Year of the Reign of Our Sovereign Lord, George the Second by the grace of God of Great Britain, France and Ireland , Defender of the Faith etc. And in the Year of Our Lord God One Thousand Seven Hundred and Thirty Four.

I, Sir Robert Kemp of Ubbeston, in the County of Suffolk, Baronet, being in good and perfect health and of sound and disposing mind and memory (Praised be to God for the same) and calling to remembrance the Certainty of Death and the uncertainty thereof do make, ordain and declare this my last Will and Testament in manner and form following.

And first and above all things I Commend my Soul into the merciful hands of Almighty God, my Maker hoping and through the merits of the most precious death and Passion of my Blessed Saviour Christ to be made partaker of His Everlasting Kingdom of Heaven. And my Corruptible Body I commit to the Earth to be decently buryed at Gissing in my Vault there in Gissing Church between my two former Wives and right by my late deceased Wife decently and privately that is to say to be put into two coffins but a timber one within the Leaden one in the same manner as my late Dear Wifes was and made by the same persons in M--- if living that made my Dear Wifes to be carryed in a Hearse and a Mourning Coach. For my Children to attend my Body. And to be carryed to the Vault by my Tenants at Gissing who I desire may have Gloves and Hatbands and their Wives Gloves.

And for settling of such Goods and Temporal Effects which it hath pleased Almighty God to bestow upon me in this World I do give and dispose the same as followeth. First I give and dispose unto my Eldest Son, Robert Kemp, Esq. and his Heirs, Executors, Administrators, and Assigns, All and Singular my Mannors, Messuages, Lands, Tenements and Hereditaments whatsoever and of what kind or nature soever situate lying and being in the Kingdom of Great Britain To have and to hold to him the said Robert Kemp, my son, his Heirs, Executors, Administrators, and Assigns forever upon Condition that he my said son, Robert Kemp, his Heirs or Assigns Do well and truly pay or cause to be paid (out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments) unto Dame Amy, my loving Wife the Annuity of three hundred pounds a year which I settled upon her before Marriage with me in such manner as the same by such Settlement is directed and appointed to be paid free and clear of all taxes and charges whatsoever.

And also I give and devise unto my said son Robert Kemp,his Heirs, Executors, Administrators, and Assigns, all my goods, Chattells and Personal Estate of what kind soever not hereonafter by me bequeathed.

And also upon this further condition as he my said son Robert Kemp, his Heirs,or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to him my said son Robert Kemp) well and truly pay, or cause to be paid unto my daughter Elizabeth Kemp, the sum of nine hundred and fifty pounds for which sum of money I have given her a Bond bearing date the first and twentieth day of December which was in the Year of Our Lord God One Thousand Seven Hundred and Thirty One. And shall likewise pay or cause to be paid unto her the said Elizabeth Kemp, my daughter, the sum of fifty pounds of good and lawfull money of Great Britain to make the said Sum of nine hundred and fifty pounds the Sum of one thousand pounds.

And also upon this further condition that he my said son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to him my said son Robert Kemp) well and truly pay, or cause to be paid unto my son Isaac Kemp the sum of four hundred and forty pounds being the remaining part of eight hundred pounds due to him upon Bond bearing date the first and twentieth day of the Lord God One thousand, Seven Hundred and Thirty Two. It being also the remaining part of the Debt due to him the Gift of Mr Isaac Brand..

And shall likewise pay or cause to be paid unto him my said Son Isaac Kemp the sum of five hundred and sixty pounds of good and lawfull money of Great Britain to make his portion One Thousand Pounds.

And also upon this further condition that my my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to him my said Son Robert Kemp) well and truly pay, or cause to be paid unto my Son Thomas Kemp the sum of one thousand pounds for which sum of money I have given him a Bond bearing date the thirtieth day of September past being the remaining part of a Debt due to him by the Gift of the said Mr Isaac Brand.

And shall likewise pay or cause to be paid unto him my said Son Thomas Kemp the Sum of One Thousand pounds of good and lawful money of Great Britain to make his portion two thousand pounds.

And also upon this further condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to him my said Son Robert Kemp) well and truly pay, or cause to be paid unto my Son Benjamin Kemp the sum of sixteen hundred pounds for which sum of money I have given him a Bond bearing date the thirtieth day of January, which was in the year Of Our Lord One Thousand, Seven Hundred and Twenty Nine being part a debt due to him by the Gift of the said Isaac Brand. ..

And shall likewise pay or cause to be paid unto him my said Son Benjamin Kemp the sum of nine hundred pounds of good and lawful money of Great Britain to make his portion Two thousand five hundred pounds.

And also upon this further Condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore deviseth to him my said son Robert Kemp) well and truly pay, or cause to be paid unto my Son William Kemp the sum of five thousand pounds of good and lawfull money of Great Britain when he shall have attained his full age of one and twenty years.

And also upon this further Condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore deviseth to him my said Son Robert Kemp) well and truly pay, or cause to be paid unto my Daughter Martha Kemp the sum of fifty pounds of like lawfull money yearly and every year for her Maintenance by four equal payments in the year free and clear of all manner of taxes and charges whatsoever until she, my said Daughter, shall have attained her full age of one and twenty years or marry which shall first happen.

And it is my Will and dearest Desire that Dame Amy Kemp my loving Wife would have the care and management of my said Daughter, Martha.

And after my said Daughter Martha Kemp shall have attained her full age of one and twenty years or be marryed, shall likewise pay or cause to be paid unto my said Daughter Martha Kemp the sum of two thousand pounds of good and lawfull money of Great Britain for her portion.

And if it shall happen my said Son William Kemp or my said Daughter Martha Kemp or either of them shall dye before he or she shall attain the age of one and twenty years or before the said Martha should happen to be marryed, then my Will and Desire is that my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named well and truly pay, or cause to be paid unto the survivor the sum of five hundred pounds of like lawfull money to make his or her portion two thousand five hundred pounds.

And also upon this further condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore deviseth to him my said Son Robert Kemp) well and truly pay, or cause to be paid unto my said DaughterElizabeth Kemp,her Executors or Attorneys yearly and every year for and during the tern of her natural life the sum of sixty pounds of good and lawfull money of Great Britain by four even and equal quarterly payments in the year and free and clear of all manner of taxes and charges whatsoever. The first payment to commence and begin the first quarterly day after my Decease .

And also upon this further condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to him my said Son Robert Kemp) well and truly pay, or cause to be paid unto my Son John Kemp, his Executors or Administrators yearly and every year for and during the term of his natural life the yearly sum of fifty pounds of good and lawfull money of Great Britain by half equal yearly payments and free and clear of all manner of taxes and charges whatsoever. The first payment to commence and begin half a year after my Decease .

I give him, my said Son John Kemp his above said Annuity although I have already given him a plentiful portion, he having been hitherto unfortunate in the World.

And also upon this further condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to him my said Son Robert Kemp) well and truly pay, or cause to be paid unto my Son Isaac Kemp, his Executors or Administrators yearly and every year for and during the term of his natural life the yearly sum of sixty pounds of good and lawfull money of Great Britain by half equal payments in the year and free and clear of all manner of taxes and charges whatsoever. The first payment to commence and begin half a year after my Decease .

The reason of my given him this Annuity because he have been extravagant and spent most of the money his Uncle Brand left him.

And also upon this further condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore deviseth to him my said Son Robert Kemp) well and truly pay, or cause to be paid unto my Mother-in-Law, Mrs Elizabeth Spencer yearly and every year the sum of eighty pounds

And unto Lawrence Ellis of Halesworth in the said County the sum of four and twenty pounds yearly and every year in such manner and at such times as I have secured and settled the said several Annuities of eighty pounds and four and twenty pounds to be paid.

And also upon this further condition that he my said Son Robert Kemp, his Heirs or Assigns and my Executrix and my other Executor hereinafter named (shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore deviseth to him my said Son Robert Kemp) well and truly pay, or cause to be paid yearly and every year during the life of the said Mrs Elizabeth Spencer (If the said Mrs Spencer does not live in Edwardston Hall in the said County of Suffolk) the yearly sum of five pounds of Lawfull money of Great Britain unto the Poor of the said Parish of Edwardston, payable to the Church Wardens there by two equal payments namely on the fifth day of November and the thirtieth day of January in every Year according to the Last Will and Testament of John Brand, late of Edwardston aforesaid, Esq. Deceased, my Father-in-Law.

And my Mind and Will is if the said Robert Kemp, my Son, his Heirs or Assigns shall neglect or refuse to pay the Annuityes or Several Sums of Money or any part of those therein before by me devised to my Daughter, Elizabeth or Sons, Isaac, Thomas,Benjamin, William and Daughter, Martha or the several Annuityes payable to my Daughter, Elizabeth Kemp, my said Son, John Kemp and to my Son, Isaac Kemp, Mrs Elizabeth Spencer, Lawrence Ellis and to the Poor of Edwardston aforesaid or any of them or their assigns, severally and respectively, to enter into all or any part of the said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to the said Robert Kemp, my Son, his Heirs or Assigns. And to Hold and Enjoy the same until she, he or they shall be fully answered and paid all such and so much of her, his or their Annuity of Annuityes and Sum and Sums of Money as shall be so in Arrears and Unpaid together with all Costs and Charges occasioned by such Entry or Entrys made.

And I do give and Bequeath unto my said Daughter, Elizabeth Kemp one Silver Salver markt with M.K. and E.K.,a pair of Silver Salvers with a fine small Rigg? about the Edges and Six Silver Plates, marked A.K.

And also I do give and Bequeath unto my said Son, William Kemp and to my said Daughter, Martha Kemp, the sum of fifty pounds a piece of Good and Lawfull Money of Great Britain when they shall attain their respective Ages of one and twenty years being in lieu of two pieces of Gold value fifty pounds each being most of it their Mothers and which I have made use of. But my Mind and Will is that if either my said Son, William Kemp or my said Daughter, Martha Kemp shall happen to dye before he or she attain the age of one and twenty years then I give and Bequeath the said Sum of Money to the survivor.

And also I give unto my said Son, William Kemp, a pair of Silver Candlesticks (not with my Arms) which were his late Mothers.

And also I give unto my said Daughter, Martha Kemp, the small Bed Bedstead and the Furniture belonging to the said Bed in which she now lyes in. And a Silver --- Candlestick and a Silver Tea Pot and Saucer which were her late Mothers and which she have now in her own Possession.

And also I give and bequeath unto the said Dame Amy, my loving Wife, the sum of one hundred pounds of good and lawful money of Great Britain to buy her Mourning and also my Picture that hangs up in her Dressing room. And also it is my Will and Desire is that she will take whatever Boots she like or desire which are in her Closet within her Dressing room. And the residue of the Boots (which were my late Wifes) may be divided between my said Son, William Kemp and my said Daughter, Martha Kemp.

And also I give and bequeath unto my Daughter, Blois [Mary?] the sum of ten pounds to buy her Mourning.

And also I give and bequeath unto my Brother, William Kemp Esq.the sum of four pounds to buy him Mourning.

And also upon this further condition that he my said Son, Robert Kemp, his heirs or Assigns, shall erect a Monument in my Isle [sic] in Gissing Church where my Vault is in such manner and according to such Directions as I shall leave set down in a Paper Inclosed in this my last Will and Testament.

And also I give to the Poor of Gissing, aforesaid the Sum of Forty Shillings to be distributed among them soon after I am Interred. And also Forty Shillings a year for four years after my Decease. The day of Distribution of such Annual Sum in the said four years to be on or near such day of the month that I shall happen to be buryed on. And to be disposed of by the Minister of Gissing together with the Advice and Assistance of whomsoever shall be Bailiff to my Estate at Gissing.

And also I give to the Poor ofUbbeston, aforesaid the Sum of Forty Shillings to be distributed among them soon after my Decease . And also Forty Shillings a year for four years after my Decease. The day of Distribution of such Annual Sum in the said four years to be on or near such day of the month that I shall happen to dye. And to be disposed of by the Minister and Parish Officers of Ubbeston aforesaid for the time being.

And also I give to the Poor of Flordan, Twenty Shillings to be distributed among them soon after I am Interred. And Twenty Shillings a year for four years after my Decease. The day of Distribution of such Annual Payment in the said four years to be on or near such day of the month that I shall happen to dye. And to be disposed of by the Minister and Parish Officers of Flordan for the time being.

And also I will and my desire is that my said Son Robert Kemp, and my Executrix and my other Executor hereinafter named shall out of all my said Mannors, Messuages, Lands, Tenements and Hereditaments and other in my estate hereinbefore devised to him my said Son Robert Kemp well and truly pay, or cause to be paid all my debts (a particular of which I shall leave set down on a paper inclosed in this my last Will and Testament) Legacys, Funeral Charges and Probate of this my last Will and Testament.

And upon the great Trust and Confidence which I have and so repose in my said Loving Wife, Dame Amy Kemp and the said Robert Kemp and John Kemp, my Sons, I do hereby Constitute and Appoint the said Dame Amy Kemp, my Loving Wife and the said Robert Kemp and John Kemp, my Sons, Executrix and Executors of this my last Will and Testament.

And I do give unto my said Son, John Kemp, (if he does Act) one hundred Guineas for his trouble.

And hereby revoking and annulling all and every other Testament or Testaments, Will and Wills before by me made and declared Either by Word or Writing, I do declare this to be my last Will and Testament being contained in four sheets of paper, to every sheet whereof I have set my hand and fixed my Seal to a labell put through the tops thereof in the presence of those Witnesses whose names are hereunder written - Robt.Kemp - Signed Sealed Published and Declared by the said Testator Sir Robert Kemp Baronet as his last Will and Testament in the presence of us, who in his presence have set our hands as Witnesses thereto - Tim Gowing, William Woodbridge, James Borlliwick.

This Will was proved at London the tenth day of May in the year of Our Lord One thousand, seven hundred and thirty five? Before the Worshipful Thomas Walker, Doctor of Law and Surrogate to the Right Worshipful John Butterworth, Doctor of Law, Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the oaths of Sir Robert Kemp Baronet and John Kemp, Esq. the sons and two of the Executors in the same Will named to whom Administration was granted of all and Singular the Goods, Chattells and Credits of the said deceased, they being first sworn duly to Administer reserving power to make the --- to Dame Amy Kemp, Widow, the Relict and other Executor, when she prays the same.
